Amicus Briefs

Innisfree participates court proceedings as an amicus in appropriate cases. We are open to requests for amicus participation on the topics listed below. This is not intended to be an exhaustive list. However, Innisfree has limited resources to draft and file amicus briefs. Accordingly, we are most interested in cases addressing legal issues with implications that go beyond the actual parties to the case.

Special education disputes (e.g., IDEA, Section 504)

In particular, we are interested in supporting the parents’ position in disputes over the provision of an IEE, and inclusion claims (i.e., that the proposed or actual IEP does not place the child in the least restrictive environment practicable).

We will consider appearing as amicus in other special education disputes on a case­by­case basis.

  • Discrimination disputes (e.g., Section 504, the American with Disabilities Act
  • OPRA disputes against schools.
